A defendant shall be punished by imprisonment for three years.

Punishment of the crime

No one shall engage in a business of raising funds from many and unspecified persons without obtaining authorization or permission, making registration, making a report, etc., and agreed to pay the total amount of contributions or an amount in excess thereof in the future, without any permission, permission, or making any other similar act of receiving contributions.

On January 8, 2011, the Defendant stated to the effect that, without obtaining authorization, permission, registration, report, etc., from the office of the third floor in the E-S., the Defendant: (a) the Victim F, “I would come to a gold of 99.9% if I collect the gold from AB and set it in Seoul; (b) would sell the gold, and would make a dividend if I make a profit. If I make an investment in this project, a dividend of 5-10% of the investment amount shall be paid every month and the dividend shall be paid until the investment amount is returned. The principal of the investment shall be paid immediately if I talk only before the month.”

The Defendant received 20 million won from the said victim’s belief to the Agricultural Cooperative Account in the name of the Defendant on the same day, and received from October 2010 to January 10, 2012 the remainder of the sum total of KRW 1,068,000,000 from the said 23 victims, including the sum total of KRW 1,068,00,000,000, from June 26, 2009, which was received from G from October 201 to October 26, 2012.

However, there is no particular property and income, and there is no evidence that the Defendant received and sold the money actually from the victims, and even if the Defendant received money from the victims as a juristic person created to receive money without delay, it is so-called the money received from the new victims, which is again paid to the existing victims as a profit.
