1. The defendant shall pay to the plaintiff KRW 428,451,932 as well as KRW 173,422,449 as to the plaintiff from July 27, 2005 to November 17, 2005.
Reasons
1. Basic facts
A. On August 9, 2002, the Credit Guarantee Fund entered into a credit guarantee agreement between the Defendant and the Defendant, setting the term of guarantee on August 8, 2003, with respect to the Defendant’s debt of KRW 170,000,000 out of the 200,000,000,000 as the date and time loan repayment from the National Bank of Korea, and its subordinate debt. B, as the Defendant’s credit guarantee agreement, jointly and severally guaranteed the Defendant’s credit guarantee liability in accordance with the above credit guarantee agreement.
B. On December 2, 2002, the Korea Technology Credit Guarantee Fund entered into a credit guarantee agreement with the Defendant on December 2, 2002 that guarantees the Defendant’s small and medium financial funds of KRW 270,000,000,000 and its subordinate obligations, which are 300,000,000, and its subordinate obligations. B and C stand a joint and several surety for the Defendant’s indemnity obligations under the above credit guarantee agreement with the Korea Technology Credit Guarantee Fund.
C. The Korea Technology Credit Guarantee Fund on June 29, 2005, and the Korea Credit Guarantee Fund on July 27, 2005, in accordance with the above credit guarantee agreement, subrogated to the Defendant's respective loans and obligations on July 27, 2005.
On December 29, 2005, the Korea Technology Credit Guarantee Fund filed a civil suit against Defendant B, B, and C with the Seoul Central District Court Decision 2005Da21233, and received the judgment that “the Defendants jointly and severally paid to the Plaintiff 253,509,623 won, and 249,042,43 won, whichever is earlier, 14% per annum from June 29, 2005 to September 28, 2005, 16% per annum from September 29, 2005 to October 27, 2005, and 20% per annum from October 28, 2005 to October 27, 2005,” which became final and conclusive around that time.
In addition, the Korea Credit Guarantee Fund shall file a civil suit against the defendant, B, and C with the Seoul Central District Court 2005Kadan281515, and on January 20, 2006, the defendant shall jointly and severally file the suit with the plaintiff about KRW 174,942,309, and KRW 173,422,449, among them, from July 27, 2005 to November 205.
