Reasons

Punishment of the crime

1. From December 19, 2005, Defendant 2016, concluded a check contract with a branch office of KSB in the East capital bank and the Defendant, and traded household checks.

A. On March 8, 2016, the Defendant issued one copy of the family check in the name of the Defendant, which was named as “D”, “C”, “C million won”, and “Seoul 3,000,000,” and “Seoul 30,000,” around July 30, 2016, by the holder of the said check, on August 1, 2016, the payment period for which was presented, but did not receive deposits.

B. On March 16, 2016, the Defendant issued one copy of the family check in the Defendant’s name, which was named as “E”, “C million (3,000,000)”, “The date of issuance,” and “ July 9, 2016.” Around July 11, 2016, the holder of the said check presented payment on July 11, 2016, but did not pay for the shortage of deposits.

2. From December 19, 2005, Defendant 2407, concluded a household check contract with a branch of KSB in the Dongdaemun-gu one bank and traded checks.

A. On April 4, 2016, the Defendant issued one copy of the household check with the check number “G”, the check amount “C million won (3,000,000)”, and the date of issuance “F August 20, 2016,” at the “F office operated by the Defendant in the Jongno-gu Seoul Metropolitan Government B market.” The Defendant presented the said check by the holder of the said check within the payment deadline, but did not receive the deposit shortage.

B. The Defendant issued one copy of a household check with the date and time, place, as set forth in Article 2-2(a), “H”, “C million (3,000,000)”, “the date of issuance”, and “the date of August 20, 2016.” The Defendant offered payment within the payment deadline, but did not pay for the shortage of deposits.
