Basic Facts

From December 2, 2012 to September 20, 2019, the Plaintiff retired from office while serving in the Defendant Company.

At the time of the plaintiff's retirement, unpaid wages are KRW 10,709,978, and retirement allowances are KRW 22,205,571.

On October 29, 2019, the Defendant paid KRW 248,248 to the Plaintiff’s retirement benefit account.

[Based on the facts without dispute, Gap evidence 1, Eul evidence 1, and Eul evidence 1 through 3, and the purport of the whole oral argument as above, the defendant shall pay 32,915,549 won in total to the plaintiff as wages and retirement allowances. 248,248 won in total paid by the defendant after the plaintiff's retirement in the order of statutory appropriation as provided in Article 479 of the Civil Act, unless the plaintiff has agreed to repay debts, the above 32,915,549 won in total shall be appropriated for 450,897 won in total (32,915,549 x 205 x 365 x 2945) in the order of the above statutory appropriation as provided in Article 479 of the Civil Act from October 5, 2019 to October 29, 2019 to 204, 294 won in total and 205 won in total (the remaining damages for delay shall be appropriated to the plaintiff from 2940.25 won in total).

In conclusion, the plaintiff's claim is justified, and it is decided as per Disposition.
