Punishment of the crime

피고인은 2013. 9. 15. 00:20경 업무로써 혈중알코올농도 0.149%의 술에 취한 상태로 B 그랜저 승용차를 운전하여 구미시 원평동에 있는 김정문칼국수 앞 도로를 산업도로 방면에서 금오시장 방면으로 직진 진행하던 중, 술에 취하여 전방 및 좌우 주시의무를 소홀히 한 업무상 과실로 진행방향 왼쪽 앞에서 걸어가고 있던 피해자 C(여, 25세)의 무릎 부분을 위 승용차의 좌측 앞 범퍼 부분으로 충격하여 위 피해자가 옆으로 튕겨나가 바닥에 넘어지게 하고, 같은 방법으로 피해자 C 옆에 있던 피해자 D(24세)의 무릎 부분을 위 승용차의 좌측 앞 범퍼 부분으로 충격하였다.

결국 피고인은 위와 같은 업무상 과실로 피해자 C에게 약 6주간의 치료가 필요한 무릎뼈의 탈구 등의 상해를, 피해자 D(24세)에게 약 2주간의 치료가 필요한 우측 슬관절 염좌 등의 상해를 각각 입게 하고도 곧 정차하여 피해자를 구호하는 등 필요한 조치를 취하지 아니한 채 그대로 도주하였다.
