A defendant shall be punished by imprisonment for not less than eight months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
[2017 Highest 4851] On June 21, 2017, the Defendant: (a) at around 06:02, at the victim C’s D office operated by Dongjak-gu Seoul Metropolitan Government, the victim’s share of the D office located in Dongjak-gu, Seoul; (b) at around 700,000 won of the market price, the victim’s share of the D office was stolen; (c) at around 06:00,000 won of the market price of the victim’s share, the Defendant

1. On April 29, 2017, around 20:15, the Defendant embezzled, on his/her own initiative, he/she did not take necessary procedures, such as returning the victim E to the victim by taking a note of one copy of the new bank e-mail card lost, and embezzled him/her on his/her own.
2. On April 29, 2017, the Defendant violated the Act on Financial Business Specializing in Fraud and Credit Financial Business: (a) purchased tobacco, etc. in the G convenience store for the use of the victim’s name and non-fluored box in Dongjak-gu Seoul, Seoul; (b) despite the absence of legitimate title to use the new bank e.g., the Defendant was issued goods equivalent to KRW 33,000 at the market price, such as tobacco, etc., from the victim who is not aware of the fact, by presenting it as if he had the right to use the said e-mail card.
In addition, from April 29, 2017 to April 30, 2017, the Defendant received goods equivalent to KRW 184,800 in total or received services on five occasions, as shown in the list of crimes, from around April 29, 2017 to around April 30, 2017, and acquired economic benefits and used debit cards lost by others.

1. On June 24, 2017, at around 07:30, the Defendant violated the Act on Specialized Credit Financial Business: (a) was willing to purchase goods or provide meals using one bank body cards located on the part of the victim’s wall; (b) around June 24, 2017, at around 07:30, the Defendant purchased tobacco from “I” located in the Dongjak-gu Seoul Metropolitan Government, Seoul Metropolitan Government on the street near the Sung-do 3 East-do; and (c) purchased the tobacco from “I” around 08:41 and around 09:00.
