The defendant shall be innocent.
Reasons
1. On August 10, 2015, the Defendant prepared a false complaint with respect to E/F using a computer at the D attorney-at-law office located in Ulsan-gu, Ulsan-gu, Seoul-do.
A written complaint states, “The real estate purchase price under Defendant E and F’s name at the Defendant’s office on April 23, 2015 is KRW 330 million, and the contract date was forged on May 1, 2015, one copy of the real estate sale and purchase agreement entered into on May 1, 2015, and the said real estate sale and purchase agreement was exercised by presenting the said real estate sale and purchase agreement as if it was a document that was duly formed upon the completion of the said real estate sale and purchase agreement at the Ulsan District Court around July 2015,” and the fact stated, E and F merely prepared a double contract for loans to be submitted to the Bank separately from the original contract in order to obtain loans for balance, etc. due to the establishment of provisional attachment and mortgage on the said real estate, and there was no fact that there was any forgery of the real estate sale and purchase agreement under the Defendant’s name.
Nevertheless, the defendant submitted the above complaint to a police officer who is unable to know his name at the public service center of the Dong-dong Police Station in Ulsan-dong, Ulsan.
As a result, the defendant had E and F receive criminal punishment.
2. In full view of the following circumstances acknowledged by the evidence duly adopted and investigated by the court, the evidence submitted by the prosecutor alone alone proves that the above accusation is false, without any reasonable doubt, that the aforementioned accusation was forged by a double contract.
It is difficult to see, and there is no other evidence to acknowledge it.
A. The E/F does not clearly explain how the Defendant consented to the preparation of a double contract (the eight pages of evidence records).
B. The accused maintained the process of preparing double contract documents.
