1. The Plaintiff:
A. As to Defendant B’s KRW 18,437,650, Defendant C’s KRW 27,450,50, and each said money, from June 7, 2006.
Reasons
1. Basic facts
A. The Plaintiff’s guarantee claim 1) The Plaintiff on November 9, 2006, as H Co., Ltd. (hereinafter “H”)
G as the representative director of G, and H entered into an agreement with the Plaintiff to provide the Plaintiff with 32 square-type 1 bonds and to pay KRW 600 million to the Plaintiff in the event that it is impossible to supply the partnership apartment. 2) H did not supply the Plaintiff with 32 square-type 1 bonds to the Plaintiff by registering the Plaintiff as a member of the I Regional Housing Association.
Accordingly, on January 16, 2008, the Plaintiff agreed to the effect that “H shall pay the Plaintiff the borrowed amount of KRW 600 million up to March 14, 2008, plus the interest calculated at the rate of 12% per annum from December 20, 2007 to the payment date.” G, the representative director of H, guaranteed the said obligation to the Plaintiff.
B. On June 7, 2006, G entered into a contract with Defendant B and J to purchase KRW 368,753,000 of each of the 55.41/608 square meters owned by the above Defendant and J among the 608 square meters of the 608 square meters of the above Defendant B and Dongjak-gu Seoul Seoul Metropolitan Government K D (hereinafter “instant contract”).
(2) On June 7, 2006, G paid the down payment of KRW 36,875,300 on the same day to Defendant B and J, and paid KRW 54,901,00 for each of the above Defendants C and C and L owned by the above Defendant and L, among the 165 square meters of the 165 square meters of the above Defendant C and C and the Dongjak-gu Seoul Metropolitan Government M & M & Ma (hereinafter “instant contract”). On the same day, G paid KRW 54,901,00 for the down payment to Defendant C and L.
C. On June 12, 2006, G and Defendant D, E, and F entered into a contract with Defendant D to purchase KRW 1,425,580,000 of the 1/2 equity and 1/6 equity of the 998 square meters of the 1/2 equity and the 1,356 square meters of the n forest in Dongjak-gu Seoul, Seoul, for KRW 1,425,580,00 (hereinafter “instant third contract”).
(2) On June 12, 2006, Defendant E and Dongjak-gu Seoul District Court Decision 1,472.7/2,952 shares in 1,472,952.
