[2014 Highest 1598] The Defendant is an employee of Han-gu, Jung-gu, Seoul, a company that is bound to pay bills.
around February 8, 2013, the Defendant: (a) received a discount of KRW 100,00,000 from the victim; (b) received a discount of KRW 90,800,000 from the victim; (c) received a discount of KRW 90,800,000 from the non-member discount business entity; (d) received a discount of KRW 90,80,000 from the non-member discount and stored for the victim; (b) around that time, the Defendant embezzled the remainder of KRW 25,00,00 from the above date to August 30, 2013 with the Defendant’s personal loan repayment, card payment, and communication fee, and embezzled the Defendant’s personal loan of KRW 65,80,000,000 from the above date to the date, and embezzled the total amount of KRW 860,500,000 at his own discretion for the victims by using the same method as the attached list of crimes.

1. In January 15, 2013, the Defendant: (a) received a discount of KRW 68,750,000 from the said Company G at the Defendant’s office of the Victim case-based Roconton Co., Ltd., Ltd.; (b) applied for a discount of KRW 68,750,000 from the said Company G; and (c) applied for a discount of KRW 64,911,438 from H to H on January 15, 2013; and (d) kept for the sake of the victim company, the Defendant paid KRW 54,139,71,730,00 to the account in the name of the victim company; and (c) embezzled KRW 10,71,708 by arbitrarily consuming the Defendant’s living expenses, etc. at around that time.
2. On January 15, 2013, the Defendant explained the part of the bill discount stated in paragraph (1) to G of the victim corporation case, Inc., Ltd., by telephoneing the phone, and then, “if there is a problem in distributing bills because of financial difficulties in the present financial situation, the sum of KRW 20,000,000,00 to KRW 10,771,708, which is the bill discount amount, will be returned immediately after 20,71,708 won.
