The defendant's appeal is dismissed.
Reasons
1. Summary of grounds for appeal (misunderstanding of facts and improper sentencing);
A. Fact-misunderstanding 1) The instant accident occurred due to negligence by the Defendant’s failure to discover the vehicle of the Defendant changing the vehicle due to the driver of the damaged vehicle’s failure to perform his duty of care at the front and the duty of safety distance maintenance, and cannot be deemed as the occurrence of a traffic accident.
2) Even if a traffic accident occurred due to the fault of a domestic defendant's fault, the defendant was not aware of the fact that the defendant had shocked the damaged vehicle because of noise and vibration high even if the vehicle driven by the defendant was worn out and driven normally.
Therefore, the Defendant did not intentionally flee, knowing that a traffic accident occurred.
B. The sentence of the lower court that is unfair in sentencing (an amount of five million won) is too unreasonable.
2. Judgment on the grounds for appeal
A. As to the assertion of mistake of facts, the following circumstances found by the evidence duly adopted and investigated by the lower court, namely, ① According to the present traffic accident situation at the time of the instant traffic accident, which can be verified through the black image of the damaged vehicle, the Defendant caused the instant traffic accident by negligence by not checking the driving situation of the vehicle in the process of changing the vehicle from the two lanes to the one lane, without checking at all the driving conditions of the vehicle in the process of changing the vehicle from the two lanes.
It is sufficient to see that there is negligence on any driving by the driver of the damaged vehicle who has driven the first vehicle at the time of the change of the vehicle by the defendant.
(2) According to the above video, it is difficult to see that both the Defendant’s vehicle and the damaged vehicle at the time of the instant traffic accident are generated a large shaking exceeding the vibration generated at the time of normal driving, and the damaged vehicle immediately entered the secondary collision in which the central separation stand.
