Punishment of the crime

피고인은 2009. 9. 4.경 원주시 B에 있는 C 법무사 사무실에서, 피해자 D에게, “내가 회사 땅을 샀는데 문제가 있어 이전 등기가 되지 않는다, 당신 소유의 원주시 E 공소장의 공소사실에는 ‘F’라고 기재되어 있으나, 이 법원이 적법하게 채택하여 조사한 증거들에 의하면 ‘E’이므로 위와 같이 범죄사실을 인정한다. 땅(이하 ‘이 사건 토지’라 함)을 내 앞으로 해 주면, 그것을 아버지에게 보여주고 경비를 받을 수 있다. 1년만 쓰고 다시 소유권 이전해 주겠다. 1년 뒤에 소유권을 이전하지 못하면, 토지 대금 7,040만 원을 변제하겠다”는 취지로 말하였다.

However, even if the defendant did not have any particular property or income at the time and received the ownership of the land of this case from the victim, he did not have any intent or ability to transfer the ownership of the land to the victim or to pay the price of the land as agreed upon by the defendant.

Ultimately, the Defendant, by deceiving the victim as above, had the victim register the land of this case equivalent to KRW 70,440,000 at the market price on September 17, 2009 with ownership transfer under the name of the Defendant.
