2. Determination on the lawfulness of the instant lawsuit

A. The plaintiff asserts that the defendant is responsible for compensating the plaintiff for all damages caused by the accident of this case, and the defendant asserts to the purport that the lawsuit of this case is unlawful, since the plaintiff and the defendant reached an agreement to file a lawsuit after the accident of this case.

나. 판단 (1) 부제소 합의의 존재 ㈎ 다음 사실은 당사자 사이에 다툼이 없거나, 을 제1 내지 2호증{가지번호 포함, 각 문서에 원고가 서명한 사실에 다툼이 없으므로 각 문서 전체의 진정성립이 인정된다. 원고는 을 제1호증(합의서), 을 제2호증의 1(합의서), 을 제2호증의 2(권리포기증 에 대하여 수령금액 등 각 내용이 모두 백지상태인 문서에 서명만 하였을 뿐이고 그 이후 피고직원이 수령금액, 내용 등 나머지 부분을 임의로 기재한 것이라고 주장한다.
