A is a person working as the team leader of the I Corporation, the J is a vice president of the B Corporation, and the defendant C is a person in charge of logistics in K, which is a crowdfunding company transporting exported and import cargoes between Korea and China, and the defendant B is a corporation with the purpose of wholesale retail and service, such as electronic commerce, fashion goods, clothes, and cosmetics.

이에 피고인들은 공모하여, 2015. 12. 10. 경 EMS 우편물번호 L 등 7건으로 게 리 쏭 9 컴플렉스 크림 7 박스, 252개, 65.8kg 을 세관장에게 신고하지 아니하고 중국으로 밀수출한 것을 비롯하여 별지 범죄 일람표에 기재된 바와 같이 2015. 12. 10. 경부터 2015. 12. 22. 경까지 총 47회에 걸쳐 게 리 쏭 9 컴플렉스 크림 14,220개( 수출가격 129,402,000원) 및 클라우드 9 블 랑드 화이트 닝 12,240개( 수출가격 106,488,000원) 등 수출가격 합계 235,890,000원 상당의 화장품 26,460개를 세관장에게 신고하지 아니하고, 중국으로 밀수출하였다.
