A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for two years from the date this judgment became final and conclusive.

Punishment of the crime

“B” is a company that sells online products advertising as if profits are generated from the bitcoin transaction using the artificial intelligence computer “C” to pay profits. D as a first-order seller in the Republic of Korea of B, a person who establishes and operates a corporation E (hereinafter “E”) in order to sell online products of the above B in the Republic of Korea. The F is the subordinate seller of the above D (one-person group leader), and G is the subordinate seller (one-person group leader) of the above F (one-person referred to as “military branch leader”).

No one shall conduct any financial transaction without any transaction of goods, etc., or actually conduct any financial transaction by pretending the transaction of goods, etc. using a multi-stage sales organization or any similar organization comprised of persons who have joined such organization.

Nevertheless, the Defendant, as a subordinate seller of the above G (the team leader within the Gun branch) in collusion with the above G on October 23, 2017, recruited investors for B online goods in collusion with the above G, etc., and made profits from the transfer of funds paid by investors to the head office located in the Pakistan in the form of bitcoin and from the head office via C in the non-coin transaction. The Defendant paid 1.8 million won for the establishment of one account and 2.6 million won for the recruitment of other persons. The Defendant, in collusion with the above G, made an investment to the non-invested investors and recruited investors as well as 2.6 million won for the recruitment of other persons. It is similar to that of the sales organization, etc., which is composed of three or more persons and 2.6 million won for the recruitment of goods.
