1. The plaintiff's claim is dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Facts without dispute;
A. The Plaintiff and C are legally married couple who completed the marriage report on June 10, 2009.
B. Around August 2018, the Defendant had sexual intercourse while teaching C.

The plaintiff asserts that since the defendant knew that he had a spouse, and inflicted pain on the plaintiff, the defendant should compensate for the plaintiff's loss, and the defendant also knew of the fact that he had a spouse from around August 15, 2018, while attending the school from around the same month to around August 19, 2018, he did not commit an unlawful act with C while he knew that he had a spouse, but did not have any restriction on the school with C after he became aware that he had a spouse.

Determination as follows: (a) it is difficult to readily conclude that the Defendant was aware of the same fact before August 19, 2018, which was the date when the Defendant became aware of the spouse of C, solely on the basis of the conversation (Evidence A9) between the Plaintiff and C, which maintained a matrimonial relationship around June 10, 2019 when the instant lawsuit was pending, after ten months from the time when the Defendant and C were to be restricted; and (b) there is no other sufficient evidence to support the instant lawsuit; and

Even if the Defendant talks with the Plaintiff to the effect that the divorce between the Plaintiff and C had an intention to meet C again, it is difficult to readily conclude that the act of misconduct between the Defendant and C has continued even after August 19, 2018, and there is no other evidence to acknowledge it otherwise.
4. As such, the plaintiff's claim of this case based on the premise that the defendant had committed an unlawful act while teaching C with knowledge that he had a spouse, is dismissed as it is without any need to examine further.
