The appeal is dismissed.

The grounds of appeal are examined.

For the reasons indicated in its holding, the lower court upheld the first instance judgment that acquitted the primary facts charged and the primary facts charged of this case on the grounds that there is no proof of a crime, and found the Defendant not guilty of the grounds for the ancillary facts added by the lower court.

Examining the record, the above determination by the court below is justifiable.

There is no error of misapprehending the legal principles on embezzlement and violation of the Labor Standards Act.

Therefore, the appeal is dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
