Reasons
1. In the first instance court within the scope of the judgment of this court, the plaintiff filed a claim against the defendant as the principal lawsuit for return of advance payment, including down payment, among the construction cost following the termination of the construction contract of this case, and the defendant filed a claim against the plaintiff for compensation for damages arising from insult and intimidation. The defendant filed a claim against the plaintiff for compensation of damages equivalent to the amount of the construction cost arising from unilateral termination of the construction contract of this case due to the plaintiff's occurrence of the termination of the construction contract of this case even though the construction contract of this case was in the middle of the construction contract of this case. The court of the first instance accepted part of the plaintiff's claim, and ordered the judgment of the first instance court with the purport of dismissing the plaintiff's claim and the defendant's claim, and it is evident in the records that only the defendant filed an appeal against the cited part of the claim and the dismissed part of the above claim
2. The reasoning of the judgment of the court of first instance cited in this case is the same as that of the corresponding part of the judgment of the court of first instance, and thus, it is acceptable to accept this as it is in accordance with the main sentence of Article 420
3. Thus, the plaintiff's claim of this case is justified within the above scope of recognition, and the remaining claims are dismissed as it is without merit, and the defendant's counterclaim of this case shall be dismissed as it is without merit. The judgment of the court of first instance is just and it is dismissed as it is without merit, and the defendant's appeal is dismissed as it is so decided as per Disposition.
