A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

On February 27, 2019, the Defendant received a loan consultation through a name-free and telephone conversation and offered “a working loan company that enables a loan by using a law.” Around February 27, 2019, the Defendant received a proposal to “a request to withdraw and deliver money deposited to the Defendant’s account by withdrawing and delivering the money deposited to the Defendant’s account by creating the transaction performance.”

Accordingly, on February 11, 2019, the Defendant: (a) received a proposal from the Defendant to make the details of transactions of deposits and withdrawal and delivered a check card under the name of the Defendant; and (b) was used for the singinging crime; and (c) even if the said person was aware that he could prevent the singinging crime using the Defendant’s account, the Defendant consented to the proposal and notified the C banking account in the name of the Defendant.

Accordingly, at around 15:31 of the same day, the Defendant stated that, “no money may be subject to criminal punishment if he/she borrowed the passbook” in the physical form of “low interest rate and government support fund loan” presented by the employees of the bank in Gangdong-gu Seoul Metropolitan Government, stating that, at least 15:31, he/she may receive a low interest rate and government support fund loan, he/she shall deliver money deposited by a person who is not aware of the fact that he/she has received a telephone to withdraw or transfer the money deposited by him/her, and then withdraw the above amount of KRW 20 million as a check by submitting it to the employees of the above bank, and move it to the C bank’s address and make cash payment.
