Reasons

Punishment of the crime

Any person who intends to construct a building, change the purpose of use, install a structure, change the form and quality of land, cut bamboo and trees, divide land, store goods, etc. in a development restriction zone shall obtain permission from the competent authority.

1. As a result, the Defendants conspired to change the use of a building within a development-restricted zone without permission of the competent authority.

3. Defendant A

A. On September 2015, the Defendant, without permission from the competent authority on September 2015, installed concrete on a part of 350 square meters of land indicated in paragraph (2), which is a development restriction zone, for the purpose of profit-making, and alters the form and quality of land, and thereby, as a prefabricated panel.
