A defendant shall be punished by imprisonment for one year.

Punishment of the crime

1. 피고인은 2014. 10. 7. 01:40경 김해시 E에 있는 피고인의 집에서, 처인 피해자 F(여, 51세)이 처가에서 자고 오겠다고 말했던 것을 잊고 귀띔도 없이 외박한 것으로 오해하고 흥분하여 손으로 피해자의 목을 조르고 주먹으로 그 얼굴 등을 수회 때려 피해자에게 치료일수 미상의 구순부열상 등을 가하였다.

그럼에도, 피고인은 같은 날 07:55경 피고인의 집으로 귀가하며 “야! 이 씹팔 년아, 개같은 년아! 가만 두지 않겠다. 다시 신고해 봐라. 경찰하고 짰제 내가 경찰서장 목가지 날리뿐다.”고 고함을 지르며 피해자의 목을 조르고 손으로 그 머리채를 잡아 흔든 후 주먹으로 피해자의 몸과 팔 등을 수회 때려 넘어뜨리고 일어서려는 피해자의 발목을 잡아 당겨 피해자에게 치료일수 미상의 발목타박상 등을 가하였다.
