1. The plaintiff's claim is dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Basic facts
A. On August 13, 2014, the Defendant (around March 25, 2015, the name of the Cmarket Management Committee was changed to the current name at the management body meeting of the C Market Management Committee, which was changed to March 25, 2015) determined to D the term “329.03 square meters for each floor E, 329.03 square meters for each floor (exclusive use area)” (hereinafter “instant store”) from August 13, 2014 to August 12, 2016, from August 13, 2014 to August 12, 2016, the lease deposit amount was KRW 50,00,000, monthly rent of KRW 6,000 ( separate value-added tax), management expenses deposited, value-added tax deposited, management expenses deposited, and KRW 22,00,000 for each square year (settlement management expenses after big settlement).
(2) At the time of the instant lease agreement, the Defendant and D obtained the right to use the leased object at the same time after having received a written protocol of compromise before filing a lawsuit from the court. The key contents of the instant lease agreement are as follows.
Article 3 (Deposits)
5. If the lessee has any expenses and liability to be borne by the lessee after completing the surrender and restoration of the leased object upon the expiration of the lease term, the lessor shall refund the balance after deducting such expenses and liability from the deposit and management deposit.
Article 4 (Monthly Rent and Management Expenses)
4. The lessee shall pay monthly rent and management expenses even if he/she has not used the leased object during the term of validity of the lease contract;
Article 5 (Late Payment) If the lessee fails to pay monthly rents, management expenses, and other monetary obligations to be paid to the lessor in accordance with the lease agreement, he/she shall pay the overdue charge of 24% (2%) per annum for the number of days in arrears from each due date plus the overdue charge for the number of days in arrears.
Article 9 (Duration)
1. The lessor and the lessee shall be entitled to extend the contract for one year under the same terms and conditions as this contract, if no separate expression of intent is made in writing thirty (30) days before the expiration of the term of the lease;
