A defendant shall be punished by imprisonment for not more than ten months.

Punishment of the crime

On December 20, 2018, the Defendant was sentenced to eight years of imprisonment for attempted murder at the Daegu High Court, and the said judgment became final and conclusive on December 28, 2018.

1. The Defendant is a dentist who is an employee of the real estate brokerage office, and the victim B (the age of 55) is a dentist who operates the “D dental department” located in the area of Cheongju-si C.

피고인은 2011. 12. 15. 피해자로부터 임플란트 시술을 받은 뒤 2016. 8.경 위 병원에서 진료 중인 피해자를 찾아와 “임플란트 시술한 곳에 염증이 생겨 하얀 가루가 나온다, 통증이 심하고 만성 두통에 시달리는데 돈을 주지 않으면 가만두지 않겠다”라고 위협하면서, 피해자에게 “돈과 땅은 주지 않으면 전기톱, 사시미 칼로 죽여 버리겠다, 차에 총이 있는데 그 총으로 쏴서 죽여 버리겠다, 집이 어딘지 알고 있는데 가족도 다 죽여 버리겠다, 너 같은 건 애들 풀어서 바로 묻어 버릴 수 있다, 치과 손님과 언론에 다 공개하겠다”라고 겁을 주었다.

From around that time to January 2017, the Defendant received a total of KRW 66.5 million by threatening the victim and receiving KRW 40 million in cash several times from the food victim, as described in the attached list of crimes, as well as by threatening the victim over five times.

Accordingly, the defendant was given property by threatening the victim.

2. On February 14, 2018, the Defendant: (a) at the foregoing hospital, the Defendant: (b) stated that “I would die without being aware of the fact that I would have a problem in the hospital, and would open to the customer and the press what I would like to the public; (c) I would have been attempted to commit a wind that I would no longer have the victim followed; (d) I would like to have the victim receive KRW 150,000,000,000 from another person; and (d) I would like to die without being aware of the fact that I would have a problem in the hospital.”

Accordingly, the defendant attempted to receive property by threatening the victim.
