1. Defendant B Co., Ltd. shall pay to the Plaintiff KRW 320,158,630 as well as to the Plaintiff from March 18, 2014 until July 15, 2014.
Reasons
1. Basic facts
A. The Plaintiff is a corporation that prints and produces various kinds of goods, such as boxes and stuffs in the building on the ground (hereinafter “instant damaged building”). Defendant A is the owner of the D, E, and F ground buildings adjacent to the instant damaged building (hereinafter “instant building”); Defendant B (hereinafter “Defendant B”) was leased the instant building from Defendant A to December 31, 2012, and disposed of waste at the same time (hereinafter “instant crushing”), and the lessee of the instant building is concurrently the occupant of the instant building.
B. Defendant B used the instant building as a workplace, transported wastes stored inside and outside of the building using a consortium mark, and treated wastes by crushinging them. In the case of March 18, 2014, Defendant B’s employees worked up to 19:00, and did not clean the wastes accumulated around the instant crushing machine, and all employees retired from the building except Nonparty G.
C. Since March 18, 2014, G found the occurrence of a fire in the mechanical room of the instant building (hereinafter “instant fire”) while repairing portable lighting lights, etc. from the sckes on or around March 18, 2014, and attempted to extinguish them by water heading, but failed, he notified H, the representative director of Defendant B, of the occurrence of a fire by leaving a telephone, and reported it to 119 on the same day.
The CCTV installed in the mechanical room of the instant building was generated near the mother of the instant scraper on March 18, 2014, around 21:25, around 2014. The images showing that the flame was spreaded to the instant fire while carrying wastes accumulated inside the mechanical room of the instant building.
E. The fire of this case is the case where waste stacks accumulated inside the building of this case are loaded, and the fire of this case is adjacent to the South west winds that were in fire at the time.
