1. The Defendant’s KRW 50,000,000 and its related amount are 5% per annum from April 13, 2018 to February 27, 2019 to the Plaintiff.
Reasons
1. Indication of claims: To be as specified in attached Form 1;
2. Grounds for recognition: Judgment without holding any pleadings (Article 208 (3) 1 of the Civil Procedure Act);
3. The Plaintiff in part of each term of delay claimed payment of KRW 50,00,000 per annum from April 13, 2018 to the date of full payment under the Act on Special Cases concerning Expedition, etc. of Legal Proceedings. However, the interest rate of KRW 15 per annum is applied from the day after the delivery of a copy of the complaint. Thus, the Plaintiff only recognized damages for delay at the rate of KRW 5% per annum under the Civil Act from April 13, 2018 until February 27, 2019, the delivery date of a copy of the complaint in this case, and the excess portion is dismissed.
