1. All of the plaintiffs' claims are dismissed.

2. The costs of lawsuit are assessed against the plaintiffs.

Details of the disposition

The related defendant is the project implementer of Gyeyang-gu Edong and Fdong-dong G Housing District Development Project (H; hereinafter referred to as the "instant project"), which is notified to the Ministry of Land, Transport and Maritime Affairs as D, and the plaintiffs are the persons who operated the factory within the said project district.

With respect to the expropriation of land in the instant project district, Plaintiff A and C, including the adjudication of expropriation of the Plaintiffs, were sentenced to the adjudication of expropriation on October 8, 2009 by the Central Land Expropriation Committee (the date of commencement of expropriation on December 15, 2009) and the adjudication on February 25, 2010 on the compensation for losses filed on May 31, 2011 (the Government District Court Decision 2010Guhap1328). The decision of recommending settlement was finalized on August 10, 2013 from the appellate court (Seoul High Court Decision 2011Nu20750).

The Plaintiffs were sentenced to a ruling of expropriation on October 29, 201 by the Central Land Tribunal (the date of commencement of expropriation on December 22, 2010) and a ruling of February 18, 201 with respect to the expropriation of obstacles and business compensation in the instant project district. Among them, the Plaintiffs were sentenced to an increase in compensation for obstacles incurred by the Plaintiff A and C (the District Court Decision 201Guhap1189) from November 15, 201, and the said ruling became final and conclusive on December 6, 2011.

On September 11, 201, the Defendant, such as a request for payment order against the Plaintiffs, voluntarily notified the Plaintiff A to voluntarily complete the relocation and transfer of obstacles until September 18, 2011. On November 7, 2011, the Plaintiff, who did not comply therewith, filed an application for payment order seeking the return of unjust enrichment for the occupation and use of land, etc. under Suwon District Court Sung-nam Branch Branch 201 tea 6368, and received a payment order on November 15, 2011.

On January 2012, A filed an objection, and completed the relocation of obstacles around January 2012, and the defendant did not pay the stamp upon the above objection, and the plaintiff's application for the payment order was dismissed on February 16, 2012.

The defendant did not move to the plaintiff B on November 2, 2012.
