The defendant shall be innocent.

1. On March 9, 2011, the Defendant, as the representative of the construction business chain “C”, concluded a contract for the supply and construction of goods with the victim H, the actual representative of the construction business, and the construction cost, up to April 30, 201, with the victim H, the actual representative of the construction business, and up to 68,200,000,000 won for construction work, which was ordered by the office of Cheong-do Office of Cheong-do, and ordered the victim to provide a subcontract for construction work.

The defendant paid KRW 20,460,000 to the victim as advance payment, and the above construction was conducted to the extent of half of the entire process, and the Corporation did not complete the construction within the agreed period, and the construction was not completed. On July 20, 201, from the Cheongdo-Gun Office, a supervisory authority, to use the timber that falls short of the standard in the construction process, excessive rupture occurs, and the rupture is short of the timely standard, and thus the need for reconstruction is notified.

Accordingly, the Defendant not only did there were no legitimate titles to remove the said sperm other than the administrative guidance of the Cheongdo-gun Office regarding the reconstruction of the said sperm, but also did not consult with the victim about the removal in advance, or did not obtain the consent thereto. Notwithstanding whether the said sperm installed by the victim had been removed at his own discretion and re-exploded the requirements of the Cheongdo-gun Office, and the victim had re-exploited, on July 26, 201, the Defendant, at the construction site of this case, ordered the J to excavate the said sperm (the amount of damage calculated by the victim: 4,250,000 won) by ordering the J as an excavating engineer and a dump truck driver who knew of such circumstances, and then, the Defendant removed the said sperm from the said site by using a dum truck.

Accordingly, the victim shall damage the sperm that he had been subcontracted by the defendant without permission.
