A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

On April 3, 2009, the Defendant was sentenced to a summary order of KRW 1.5 million for a crime of violation of the Road Traffic Act at the Seoul Western District Court, and was punished on July 3, 2017 by a fine of KRW 4 million for a crime of violation of the Road Traffic Act at the leisure branch of the Suwon District Court on July 3, 2017.

Nevertheless, around April 15, 2019, around 23:14, the Defendant driven a E-high-est car with approximately 300 meters alcohol concentration 0.083% while under the influence of alcohol from the front road of the Gyeonggi-si B to the front road of D.

1. The defendant of the reason for sentencing under Article 62-2 of the Criminal Act, even though he/she had been subject to punishment two times after driving under influence of alcohol, again driving under influence of alcohol.

However, the blood alcohol concentration at the time of crime was relatively high.

The sentence shall be determined as per the order, taking into account such circumstances, the defendant's age, character, environment, and circumstances after the crime.
