Defendant shall be punished by imprisonment with prison labor for up to eight months and by a fine of up to two million won.

"2015 Highest 347"

1. From November 2013, the Defendant has been engaged in the sales of goods and cash management as an employee of the “E” convenience store in the victim D’s first floor in Seongbuk-gu, Seongbuk-gu, Sungnam-si.

On January 25, 2015, the Defendant, at the above convenience store around 08:48, received the sales price of goods from an unspecified number of customers and kept in custody for the victim. At around that time, the Defendant embezzled the victim’s property by taking 757,550 won from the sales price of goods within the above convenience store for personal purposes, such as living expenses, from Sungnam-si and Pyeongtaek-si.

2. The Defendant: (a) brought up the sales price of goods in mind as described in paragraph (1); (b) brought up the convenience points; and (c) tried to steal cash at the same time as the employees work.

On February 1, 2015, at the above convenience store around 20:15, the Defendant: (a) told F, an employee of the above convenience store, to leave the school; (b) caused F, who believed it, to retire from the school; and (c) stolen the amount equivalent to KRW 378,60 in cash, which is the victim’s possession in the above convenience store, and the amount equivalent to KRW 4,500 in tobacco 1 A, which was displayed at the display stand, totaled to KRW 383,100 in total.

B. On February 16, 2015, at the above convenience store, the Defendant: (a) told G, an employee of the above convenience store, to refrain from taking particular measures; (b) cut off the amount of KRW 462,150, and the amount of KRW 4,500, the cash possessed by the victim in the above convenience store, which was displayed at the above convenience store’s treasury; and (c) cut off the amount of KRW 472,150, total of KRW 150, and KRW 472,150.

3. Fraud by using computers, etc.;

A. On February 1, 2015, the Defendant: (a) around 20:15, up to four occasions, “50,000 won for charging transportation cards held by the Defendant at the above convenience store on the card charging-only terminal of the above convenience store.”
