A defendant shall be punished by imprisonment for not less than eight months.

Punishment of the crime

1. On August 2, 2016, the Defendant violated the Road Traffic Act (Non-licenseless Driving) driving a FM520 vehicle without obtaining a driver’s license from around 15:00 to around 57 km from the front of the Defendant’s house located in Yangsan-si, Yangyang-si, Busan, the Busan, the Construction Bank Co., Ltd., to the front of the oil station in Busan, and without obtaining a driver’s license from around 57 km.

2. Around 15:50 on August 2, 2016, the Defendant, who violated the Act on the Aggravated Punishment, etc. of Specific Crimes, driven the said motor vehicle without obtaining a driver’s license, and driven the said motor vehicle according to three-lanes among the three-lane roads in front of the oil station E in Busan Metropolitan City.

Where a person engaged in driving a motor vehicle follows another motor vehicle traveling in the same direction, he/she shall secure a necessary distance to avoid any collision when the motor vehicle traveling ahead stops suddenly.

그럼에도 피고인은 자동차 운전면허를 받지 아니하고 안전거리를 확보하지 않은 채 운전한 업무상 과실로, 마침 피고인의 자동차 진행방향 앞에서 정차를 하고 있던 피해자 G( 여, 31세) 이 운전하는 H 모닝 승용차의 뒷부분을 피고인의 자동차 앞부분으로 들이받고, 그 충격으로 위 모닝 승용차가 앞으로 튕겨 져 나가면서 그 앞에 정차하고 있던 피해자 I(28 세) 이 운전하는 J 포터 화물차의 뒷부분을 충돌하게 하였다.

Ultimately, the Defendant, by the above occupational negligence, inflicted injury on the victim G, such as a shouldered salt, tension, etc. requiring approximately two weeks of medical treatment, and inflicted injury on the victim I in need of approximately three weeks of medical treatment on the part of the victim I, and escaped without taking necessary measures, such as aiding the victims.
