The prosecution of this case is dismissed.

1. At around 16:40 on February 17, 2013, the Defendant: (a) committed assault against the victim by breaking the victim’s body in his/her seat and destroying his/her arms in his/her arms, while he/she was suspected of having brought a divorce lawsuit against himself/herself; and (b) he/she committed a dispute.

2. On July 3, 2013, the prosecution of this case is dismissed in accordance with Article 327 subparag. 6 of the Criminal Procedure Act. It is so decided as per Disposition by the assent of all participating Justices, on the ground that the defendant cannot institute a public prosecution against the clearly expressed will of the victim pursuant to Article 260 subparag. 1 and 3 of the Criminal Act.
