A defendant shall be punished by imprisonment for not less than eight months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. From April 1, 2013, the Defendant entered into a contract for the supply of land with C operated by the victim B, and supplied the goods of this kind, and concluded a false statement with the purport that “The Defendant would no longer supply the goods of this case to F, who is an employee of the victim, at the e-mail point in the window D from Changwon-si, the victim would no longer supply the goods of this case because the outstanding amount is accumulated.” On March 2, 2015, the Defendant made a false statement to the effect that “The Defendant would continue to deliver the goods of this case to provide the goods of this case as security for the right to claim the return of 30 million won rent at the store lease deposit.”
However, in fact, the defendant did not have any particular property and did not have any intention or ability to approve the payment of the land properly due to the difficulties in the management situation.
As can be seen, the Defendant belongs to the victim, and was supplied by the victim with the total amount of KRW 204,539,252 from January 1, 2015 to February 28, 2018.
2.
