3. Determination

A. An act of entering a structure is deemed to constitute a crime of intrusion on the structure, if the act was committed contrary to the explicit or presumed intent of the manager of the structure. In such cases, the actor must be aware that his/her act goes against such intent of the manager (see, e.g., Supreme Court Decisions 2013Do4299, Feb. 13, 2014; 90Do755, Jul. 10, 1990). B. According to the evidence duly adopted and duly examined by the court, the Defendant was working as a member of the “F” (the trade name appears to be changed to “G”), while working as a member of the victim’s office located in the instant building 802, Jun. 15, 2015.
