1. Judgment on the main defense of this case

A. As to the lawsuit in this case where, on the ground that the Plaintiff’s respective real estate listed in the [Attachment 1] List owned by the Plaintiff (hereinafter “each of the instant real estate”) title trust to six family members, including CJ, CK, CL, CM, CM, CN, and CO (hereinafter “CJ”) of the Plaintiff, their successors seek implementation of the procedure for ownership transfer registration on the ground of termination of title trust with respect to each of the Defendants’ shares in the name of each of the instant real estate, part of the Defendants asserted that: (a) there was no right to represent the Plaintiff; and (b) there was no legitimate general assembly resolution as to the instant lawsuit; and (c) there was ratification of the lawsuit in this case by the BL, who was delegated by the CP, who is the parties to the lawsuit, to the first instance; (d) however, the CP still has no legitimate general assembly resolution as long as it is unclear whether they are the parties to the lawsuit or not.

B. The representative of a clan shall be elected according to the regulations or general practices of the clan, but if not, the head of the clan or the head of the clan shall convene the clan from among the members of the clan and elect by the resolution of a majority of the members present, according to general customs, and if not, the head of the clan or the head of the clan shall not be appointed by the head of the clan nor shall the head of the clan be appointed by the head of the clan be notified to the members of the clan who are obvious that they have been residing in the Republic of Korea because they are the head of the clan or the head of the clan and shall notify the members of the general customs

The general meeting of the clans shall determine the scope of the clan members subject to notification for convocation by the clan members unless there are special circumstances, such as errors in the descriptions of the clan members, and the location of the clan members shall be made every effort as possible.
