A defendant shall be punished by imprisonment for four years.

The defendant shall be ordered to complete a sexual assault treatment program for 80 hours.

Punishment of the crime

The defendant is the father of the victim who married with the mother D of the victim C (V, 16 years old) around May 201.

2. 성폭력범죄의 처벌 등에 관한 법률위반( 친족관계에 의한 강간), 아동 ㆍ 청소년 의성보호에 관한 법률위반( 강 간) 피고인은 2016. 1. 말경 제 1 항 기재 피고인의 주거지 안방에서 처 D가 외출한 틈을 이용하여 피해자를 강간할 것을 마음먹고, 피해자에게 성관계를 요구하면서 “ 나를 좋아해 줬으면 좋겠다, 성관계를 거부하면 엄마에게 깽판을 치고 엄마를 죽여 버리겠다, 가정이 파탄 날 수 있다 ”라고 협박하며 피해자를 침대에 눕히고 피해자의 옷을 강제로 벗긴 뒤, 피해자가 ‘ 하지 말라’ 고 피고인의 몸을 밀치며 반항하자 피해자의 배 위로 올라가 손으로 피해자의 손을 잡아 눌러 피해자의 반항을 억압한 채 피해자를 1회 간음하여 강간한 것을 비롯하여 그때부터 2016. 7. 말경까지 별지 범죄 일람표 기재와 같이 11회에 걸쳐 친족 이자 아동 ㆍ 청소년인 피해자를 강간하였다....
