A defendant shall be punished by imprisonment for six months.

except that the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

On October 8, 2018, at around 23:35, the Defendant committed assault, such as: (a) the victim’s breast part was tightly sealed three times, and (b) the victim was spawded with both arms, and (c) the victim was spawded, who was dispatched to the scene after receiving a 112 report to the effect that “the drinking person spawds down,” and (d) the circumstances belonging to the Daegu Western Police Station C District unit of the Daegu Western Police Station called the Defendant, who was spawding back to the scene; (b) the Defendant expressed that “the spawd spawd down, where inside the inside the inside the country, could be killed by one hand.”

Accordingly, the defendant assaulted police officers, thereby obstructing police officers from performing their legitimate duties in relation to the handling of 112 reported duties.

1. In order to establish the legal order of the country of reasons for sentencing under Article 62(1) of the Criminal Act and eradicate the light of public authority, it is necessary to strictly punish the crime of obstruction of performance of official duties.

However, the punishment as ordered shall be determined in consideration of all the sentencing conditions shown in the arguments of this case, such as the defendant's confession, mistake, the fact that there is no record that the defendant has been punished for obstruction of performance of official duties, and the defendant's age, character and conduct, environment, family relationship, means and result of the crime, and circumstances after the crime.
