The prosecution of this case is dismissed.
Reasons
1. As shown in the separate sheet of facts charged
2. Determination
(a) Applicable legal provisions: Article 109(1) and Article 36 of the Labor Standards Act, and Article 44 Subparag. 1 and Article 9 of the Guarantee of Workers' Retirement Benefits Act;
(b) Crimes of non-criminal punishment: Article 109 (2) of the Labor Standards Act, and the proviso to Article 44 of the Guarantee of Workers' Retirement Benefits Act;
C. B and C expressed their intent not to be punished against the Defendant by submitting a written withdrawal of their petition and accusation on August 21, 2018 after the institution of the instant prosecution.
