1. The instant lawsuit shall be dismissed.

2. The costs of lawsuit shall be borne by each person;

With respect to the instant lawsuit filed on the ground that the instant movable was owned by the Plaintiff, since the Defendant had a defense of safety that the auction procedure had been completed, the instant lawsuit was dismissed on August 11, 2016, since the auction procedure for corporeal movables related to the instant movable (this court 2016No. 875) was in progress on August 11, 2016 and the distribution procedure has been completed. As such, the instant lawsuit was filed by a third party and sought an objection and exclusion of enforcement against a compulsory execution being practically underway by infringing on the ownership or right of a third party who has the right to prevent transfer or transfer of the object of compulsory execution (see, e.g., Supreme Court Decision 96Da49049, Oct. 10, 197).
