1. On February 25, 2015, the Defendant made a false statement to the victim C that “If money is needed to engage in the business of admitting large scale pictures in E-cafeteria, the Defendant would pay interest at KRW 300,000 per month until July 2015, the principal will be repaid.”
However, in fact, the Defendant was thought to use the money borrowed from the damaged party to repay the said money to another person who was incurred in gambling by the Defendant at the time of gambling. Since the Defendant continued to increase the debt and thus preventing the repayment of the debt, the Defendant did not have any intention or ability to repay the borrowed money as promised to the injured party.
On February 25, 2015, the Defendant, by deceiving the victim, received KRW 9.7 million from the victim, to the account in the name of the Defendant, around February 25, 2015, from the victim, and acquired money by transfer from the victims in total amount of KRW 95.1 million from around that time to October 23, 2015, as stated in the attached crime list.
2. The Defendant, as described in the foregoing paragraph 1, was liable to pay a large number of debts to the Victim Non-NK Capital Co., Ltd., the Defendant purchased a motor vehicle with an installment loan from a person without his/her name on May 2016 and, if he/she disposes of the vehicle on a large scale, was offered a proposal to pay the vehicle immediately, he/she would be paid the vehicle in cash.
On May 18, 2016, the Defendant loaned KRW 19.9 million to the victim Non-Indicted Capital Co., Ltd. Co., Ltd. (hereinafter referred to as the “FFF”) through his name-free employees at the office of Lone Star Branch, Inc., Ltd. (hereinafter referred to as the “FFFFF”) around Suwon-si around 18, 2016, on the condition that 583,523 won shall be repaid each month between 48 months and 48 months, and thereafter, purchased the FFFF car with the above loan. The Defendant mortgaged the victim company around that time.
