1. The Defendant shall pay to the Plaintiff KRW 40,304,709 and the interest rate of KRW 15% per annum from September 22, 2017 to the day of complete payment.
Reasons
1. On December 19, 2016 and January 3, 2017, the Plaintiff, indicating the claim, subrogated to KRW 40,304,709 in total for the obligations owed by C Co., Ltd. (hereinafter “Nonindicted Company”) to Jeju Capital Co., Ltd. (hereinafter “Nonindicted Company”) on behalf of the Plaintiff.
The defendant, as the representative director of the non-party company, promised to pay the amount of subrogation to the plaintiff around December 2016.
Therefore, the defendant is obligated to pay the above money and damages for delay to the plaintiff.
2. Article 208 (3) 3 of the Civil Procedure Act (Judgment by public notice) of the applicable provisions of Acts;
