Defendant shall be punished by imprisonment for not less than two years and six months.
Reasons
Punishment of the crime
1. On February 2, 2015, the Defendant, against the victim C, expressed to the victim C at a university-friendly address that “on the same day, if he/she lends money to him/her, he/she would repay it immediately” through telephone communications and text message, and received KRW 92,50,00 from the victim C to the account under the name of the Defendant on the same day.
However, the Defendant did not have any particular income due to the absence of a certain occupation at the time, and the obligation of KRW 0,000,000 was accumulated since 2014, and the amount of entertainment expenses, living expenses, etc. was loaned from other persons without any income. Therefore, even if the Defendant borrowed money from the victim C, there was no intention or ability to repay it.
Nevertheless, the Defendant received a total of KRW 234,50,500 through 124 times from around that time to June 14, 2016, in the same manner as the list of crimes in attached Table 1, including the case of deceiving the victim C, as above, and acquired it by defrauded.
2. On August 20, 2016, the Defendant’s fraud against the victim D is urgently required to pay the amount to be used as monthly and living expenses to the victims of university-friendly job offers D at the Buddhist land.
Sending text messages to the effect that “on lending money immediately shall be repaid.”
In the same day, 200,000 won was remitted from the victim D to the account in the name of the defendant.
However, the Defendant did not have any particular income at the time, and the obligation for a large amount was accumulated, and even if he borrowed money from other universities-friendly employees C, he did not have any intent or ability to repay the money.
Nevertheless, the Defendant, as seen above, received a total of KRW 6,730,000 from around that time to January 9, 2017, in the same manner as the list of crimes in the attached Table 2 from around 2017, as well as from around January 9, 201.
