The defendant shall pay 31,867,70 won to the plaintiff and 12% per annum from November 26, 2019 to the day of complete payment.

Comprehensively taking account of the overall purport of the arguments in Evidence A Nos. 1 and 2, the Plaintiff is a person who engages in wholesale and retail business. The Defendant is a person who engages in wholesale and retail business with the trade name of “D,” and the Plaintiff and the Defendant concluded a food materials supply contract with the Plaintiff on October 10, 2019. Under the above contract, the Plaintiff supplied the goods to the Defendant until October 10, 2019, and the price for the goods unpaid until October 10, 2019 can be recognized as constituting 31,867,70 won and damages for delay at the rate of 12% per annum under the Act on Special Cases concerning the Promotion, etc. of Legal Proceedings, which is the day following the delivery date of the original copy of the instant payment order, as sought by the Plaintiff.

Therefore, the plaintiff's claim of this case shall be accepted on the grounds of its reasoning, and it is so decided as per Disposition.
