A defendant shall be punished by imprisonment for three years.

1. The defrauded (victim H) reported a recruitment advertisement of mobile phone salespersons published by the victim H, who operates a mobile phone sales store in the name of Busan-gu Busan-gu, Busan-gu, on or around March 2012, the Defendant: (a) sought the victim on or around March 2012; and (b) failed to make an excessive burden (such as the price of a mobile phone terminal, penalty for breach of contract, and an agreement on the payment of charges for a three-month period) on the part of customers because there are not many existing customers secured through ordinary businesses; and (c) failed to normally recruit customers without notifying the victim of such fact; or (d) tried to offer such an agreement to the customer without notifying the victim; or even to receive the mobile phone opening allowance from the victim by forging the application for subscription using the personal information of the customers.

On May 2012, from around September 2012 to around September 2012, the Defendant presented an excessive agreement with K and other customers to the effect that “I would be the president of Jcommunication, if I would have opened a mobile phone, would pay the mobile phone price, penalty, and the mobile phone fee for three months, and would pay the telephone fee for one year if I would subscribe to the 9,900 won rate system,” or would make a mobile phone subscription application using the personal information and identification card of the customers acquired in advance, and submitted it to the victim who could not know the fact.

On May 2, 2012, the Defendant received 345,000 won from the Defendant’s agricultural bank account through the Defendant’s agricultural bank account under the pretext of the Defendant’s mobile phone opening allowance from the victim from the time of the same year.
