1. The plaintiff's claims against the defendants are all dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Basic facts
A. On January 21, 2003, the Busan District Court received registration of the establishment of a collective security right of KRW 440,000,000 with respect to each real estate listed in the separate sheet (hereinafter “multi-household housing”) as stated in the separate sheet (hereinafter “multi-household housing”) from Daejeon District Court, Daejeon District Court No. 4403, the registration of the establishment of a collective security right of KRW 440,000 with respect to each real estate listed in the separate sheet (hereinafter “multi-household housing”) as stated in the separate sheet (hereinafter “multi-household housing”) was completed on July 20, 2006, adding the collateral of the instant senior mortgage to the instant multi-family housing on July 20, 2006.
B. On December 22, 2006, the Plaintiff registered the establishment of a mortgage of the maximum debt amount of KRW 112,000,000 with respect to each of the real estate listed in the above list 6-A, (b), (e), and (f) among the multi-household housing of this case, as the receipt by the same registry office, as to each of the real estate listed in the above list 6-C through (b) under Article 83890, the Plaintiff completed the registration of the establishment of a mortgage of KRW 112,00,000 with respect to each of the real estate listed in the above list 6-C through (f) of the multi-household housing of this case as the receipt by the registry office. On June 2, 2008, J transferred the instant senior collateral from the Plaintiff to K on September 8, 2008, and Defendant B transferred the instant senior collateral from K on November 21, 2008, and completed the additional registration of the instant senior collateral transfer on November 25, 2008.
However, among the land of this case, the land of Jung-gu Daejeon and the land of the I is partially renounced on June 3, 2008.
