A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. Around March 11, 2019, the Defendant violated the Act on Special Cases Concerning the Punishment, etc. of Sexual Crimes (entry in a place for sexual purpose) into a female toilet with an intent to satisfy his/her own sexual desire, such as entering the left two partitions of the above female toilet for the purpose of photographing the appearance of unspecified women in the second floor of the Busan Young-gu Btel in Busan Metropolitan City on March 5, 2019.

2. 성폭력범죄의처벌등에관한특례법위반(카메라등이용촬영) 피고인은 제1항 기재 일시, 장소에서 피해자 C(가명, 여, 31세)이 위 여자화장실 내 왼쪽 첫 째 칸으로 들어오자, 위 화장실 왼쪽 둘째 칸에서 피고인의 삼성 스마트폰 동영상 촬영기능을 켠 후 한손으로 위 스마트폰을 든 채 칸막이 위로 손을 뻗어 카메라 렌즈가 피해자를 향하게 하여 피해자가 용변을 보고 있는 모습을 촬영하는 등 성적 수치심을 유발할 수 있는 피해자의 신체를 피해자의 의사에 반하여 촬영하려 하였으나 피해자에게 발각되어 미수에 그쳤다.
