Defendant shall be punished by a fine of KRW 2,000,000.

When the defendant does not pay the above fine, 100,000 won.

Punishment of the crime

1. Violation of the Act on Special Cases concerning the Settlement of Traffic Accidents and the Road Traffic Act and the defendant are engaged in driving of BKan-Paf car.

On February 12, 2015, the Defendant driven the above vehicle at around 21:35, and led to the left-hand turn to the right-hand turn from the long-term direction of the road in front of the second apartment house in the Spool-dong Kimpo-dong, Kimpo-dong, Kimpo-dong, Kimpo-dong.

At that place, there is an intersection where signal lights are installed.

In such cases, the driver of a motor vehicle has a duty of care to safely drive the motor vehicle according to the traffic signal and prevent the accident in advance by reducing speed and by examining the right and the right of the front side of the motor vehicle.

Nevertheless, the defendant neglects this and makes a left turn in violation of the right turn signals.

On the other hand, the upper part of the DNA options car driving by the victim C(the age of 51) who was driven by the normal signal from the long-term side of the moving direction to the front part of the vehicle being driven by the victim C(the age of 51).

이로써 피고인은 업무상의 과실로 피해자에게 약 2주간의 치료를 요하는 무릎뼈의 골절 유합상태 고정물 파손, 피해차량 동승자 E(47세)에게 약 4주간의 치료를 요하는 흉골선상골절 등으로 상해를 각각 입게 하였으며, 피해차량 수리금 후론트 범퍼 등 4,458,078원 상당의 물적피해를 입게 하였다.

2. A holder of an automobile in violation of the Guarantee of Automobile Accident Compensation Act shall subscribe to the mandatory insurance liable for paying a specified amount to the victims if he/she dies or is injured due to the operation of an automobile, and shall not operate an automobile not covered by the mandatory insurance on the road;

Nevertheless, the Defendant did not subscribe to mandatory insurance at the same time and place as the above paragraph (1).
