A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. 특정범죄가중처벌등에관한법률위반(운전자폭행) 피고인은 2020. 9. 9. 23:15경 광주 광산구 상무대로 416-9에 있는 광주공항사거리에 이르러 피해자 B(남, 55세)이 운전하는 C 택시의 뒷좌석에 타고 가던 중, 턱에 걸친 피고인의 마스크 착용(일명 턱스크) 모습을 본 피해자로부터 ‘마스크를 바르게 써 달라’는 요구를 받자 이에 화가 나, 피해자에게 “야이 씨팔놈아, 개새끼야”라고 욕설을 하며 손으로 오른 어깨를 잡아당긴 후 차를 세우라고 말하고, 이에 피해자가 광주 광산구 상무대로에 있는 광주공항역 3번 출구 앞 도로에 택시를 일시 정차하자 피해자의 얼굴에 자신의 얼굴을 대어 비비고 “어쩔래 씹할”이라고 욕설하며 피해자의 몸에 침을 뱉고 계속하여 “칼로 쑤셔 죽여버리겠다, 칼 줘봐”라고 겁을 주며 손으로 오른팔을 뒤로 잡아 꺾으며 얼굴과 뒤통수를 수 회 때렸다.

Accordingly, the Defendant assaulted the driver of a vehicle in operation.

2. On September 23:40, 2020, the Defendant: (a) accompanied the Gwangju Mine Police Station E box located in Gwangju Mine District D for the same reason as the foregoing “A”; (b) refused to verify the identity of the Defendant, who was requested by the slope F (Nam, 39 years old) belonging to the said police station to present an identification card; (c) stated that “I am going to his house,” “I am going to our name. I am to this fold, I am to this ring, I am on the floor of the police box; and (d) assault F, such as continuing to walk the F’s left side f one time to walk.

As a result, the Defendant interfered with the legitimate execution of duties by police officers concerning 112 reports.
