1. The Defendant’s KRW 16,413,680 for the Plaintiff and 5% per annum from June 8, 2016 to June 15, 2017.
Reasons
1. The facts subsequent to the facts of recognition do not conflict between the parties, or can be recognized by comprehensively considering the overall purport of the pleadings in each description or image of Gap evidence Nos. 1-3, 5-7 (including paper numbers; hereinafter the same shall apply).
On November 18, 2015, the Defendant entered into a contract with the Plaintiff to be transferred the business of the “D gas station” located in Kimhae-si, which was operated by the Defendant (hereinafter “instant gas station”), and entered into a basic contract (hereinafter “instant basic contract”) and a contract for the lease of facilities (hereinafter “instant lease contract”) with the Plaintiff on November 20, 2015.
Article 1 (Purpose) The purpose of this Agreement is to propose that the gas station (the Defendant’s guardian) shall use his gas station as a trademark display station(S-Oil) in the transaction with the gas station (the Plaintiff’s), and to accept the proposal of the gas station, to set forth matters necessary for the purchase and sale of the E-O products from the third light of the gas station to receive E-O-O-O-O-O-O-O-O-O-O-O-O-O-O-O-O-O-O-O-O-O-O-O-O-O-O-O-O-O-O-O-O-O.
Article 2(1)(i) grant the right to use the trademark, trade name, services, designs, etc. (hereinafter referred to as “Es-day trademark, etc.”) which the gas station deems necessary to operate an s-day trademark display station, to the gas station, and actively cooperate with the gas station so that the gas station may display the s-day trademark.
(2) Gas stations shall respect the internal and external value of the Es.I. trademark and use the Es.I. trademark within the scope and purpose approved by the T.C.
(3) No gas station may impair or impair the value of the Es/M trademark (asy as possible).
Article 5 (Use and Suspension of Es.M. Trademarks/ Services) (1) During the use of Es.M. trademarks and the provision of Es.M. services to the gas station pursuant to Articles 2 and 4, the gas station is limited.
