나. 주장 및 판단 ⑴ 이 사건 토지의 현황평가에 대하여 ㈎ 당사자의 주장 ㈏ 현황평가의 원칙 및 불법형질변경의 증명책임 ㈐ 임야 개간과 관련된 법령의 내용 이 법원이 위 각 부분에 관하여 설시할 이유는 제1심 판결의 해당 부분 이유 기재와 같으므로, 행정소송법 제8조 제2항, 민사소송법 제420조 본문에 따라 그대로 인용한다.
㈑ 판단 ① 이 사건 토지의 1966년 이후 이용상황 변화 구 분 1966년 2013년 경작지 (전, 답) 771.6㎡ (전) 1,093㎡ 경사면 등 170.9㎡ - 도로 23.9㎡ 21㎡ 하천(구거) 229.6㎡ 82㎡ 앞서 본 바와 같이 이 사건 토지의 1966년 및 이 사건 수용재결 당시의 이용상황은 아래와 같다.
