1. All of the plaintiffs' claims are dismissed.

2. The costs of lawsuit are assessed against the plaintiffs.

1. Basic facts

A. The defendant is a local government that has entered into a contract for cleaning consignment such as collection and transportation of domestic wastes with the plaintiffs, and the plaintiffs are cleaning agents.

B. In September of each year, the Defendant entrusted a private research institute with “cost analysis for the calculation of costs for collecting, transporting, and disposing of household wastes” and then received from the private research institute an analysis of costs, such as labor costs, expenses, general management costs, and profits, based on the results, the Defendant has selected a cleaning agency after bidding against the private business entity on the basis of the calculation of the contract cost for the following year.

C. Each of the Plaintiffs entered into a contract with each of the Defendant for the entrustment of cleaning, such as the collection and transportation of daily waste (hereinafter “instant agency contract”), and the main contents are as follows.

Article 1(Purpose) of the Agreement on the Business of Collecting and Collecting Household Wastes at the time of harmony shall provide for the rights and obligations between the plaintiffs by requiring them to perform the duties of collecting and transporting household wastes discharged within the jurisdiction of the defendant under the provisions of Article 13(2) of the Wastes Control Act.

Article 4 (Contract Work) The plaintiffs' work of contracting for the collection and transportation of wastes is as follows:

Article 7 (Payment of Contract Costs) (2) of the Resource Recycling Facility at the end of each month, the Plaintiffs shall claim the contract cost for the relevant month at the end of each month, and where the Defendant deems that the contract work is properly performed, it shall be paid within ten days from the date of the claim, if it is appropriate, within ten days from the date of the claim.

(3) In principle, the defendant shall calculate the cost in determining the contract cost.

Article 12 (Keeping of Proper Equipment and Human Resources) (1) The plaintiffs shall perform their duty of contract.
