Ⅰ. The summary of the facts charged is between the Defendant and the Victim C (Y, 20 years of age, name) through a cell phone-based video-recording display “B” around July 22, 2017.

1. A quasi-indecent act by compulsion on July 22, 2017, the Defendant, at around 04:30, committed an indecent act by compulsion, committed an indecent act by force on the part of the victim, who was on the part of the victim at the exit No. 7 located in Mapo-gu Seoul Mapo-gu, Seoul, by drinking the victim at the top of the Defendant’s vehicle, who was seated in the auxiliary seat and was diving, and committed an indecent act on the victim’s right upper part by knife.

2. 강제추행상해 피고인은 2017. 7. 22. 05:00경 서울 구로구 F건물 G호에 있는 피고인의 주거지에서, 피해자가 “부모님이 잠에서 깼을 시간이니 집으로 돌아가겠다.”라고 말하며 현관문 쪽으로 걸어가자, 뽀뽀를 해 달라고 요구하고, 피해자가 이를 거절하고 집에 가려고 하자 갑자기 피해자의 뒤에서 손으로 피해자의 오른쪽 가슴을 움켜잡아 이에 놀란 피해자가 바닥에 넘어지자, 피해자의 겨드랑이 사이에 양손을 넣고 피해자를 일으켜 세운 다음 또다시 손으로 피해자의 양쪽 가슴을 움켜잡고, 이에 놀란 피해자가 재차 바닥에 넘어지자 피해자를 일으켜 세운 후 바지 위로 피해자의 음부 부분을 꽉 잡듯이 만지고, 이에 피해자가 몸부림을 치며 반항하자 피해자를 바닥에 던져 넘어뜨린 다음 피해자의 배 위에 올라타 손바닥으로 피해자의 뺨을 때리고 주먹으로 피해자의 이마를 수회 내리치며 “씨발년아, 닥쳐, 입 닥치고 있으면 집에 보내주고, 안 닥치면 넌 여기서 죽어”라고 욕설을 하여, 피해자에게 입술이 찢어지고 눈썹 윗부분이 붓고 멍이 들게 하는 등 치료일수 불상의 상해를 가하였다.
